A man accused of raping a child held camps. He had already been convicted of the same act and the police knew it iROZHLAS

  • The Liberec man, who was accused by criminals last week of raping a child, has already been questioned by police. Last August, a woman helping children and foster parents in the Liberec region drew attention to her suspicious behavior.
  • She wrote to police that a man who runs children’s camps and private babysitting has twice been convicted of raping children in the past.
  • In addition, she pointed out that she has cameras in the apartment and is constantly filming children who are entrusted by his parents to him and his wife.
  • The police postponed their report and found nothing suspicious. But the man has now raped another child, and police are not ruling out that there may be more victims.

“There are cameras all over the apartment capturing the kids throughout the day. Even changing. The man carefully monitors and processes the camera recordings,” said Klára from the organization which helps children and foster families in the Liberec region.

It was August 12, 2021, and Klára had just sent a letter to the Jablonec prosecutor’s office. She feared that the president of the Children of the Railway Paradise association, Jan R., would harm the children in her apartment who had been entrusted with childcare by her parents. And she asked the police to carefully check the men.

“Especially when I learned about him that he had been convicted of rape twice,” he says. Radiožurnál knows his identity, but due to the sensitivity of the case does not publish his full name. However, Radiožurnál has its announcement at its disposal, which it sent to the police, together with the police report on the result of the investigation.

Klára became interested in Jan R. when she met one of the mothers who gave her four-year-old son childcare. “I learned from her that the man has cameras all over the apartment and that the children are constantly filming, which I find strange,” she recalls.

So she started looking. She discovered on the internet that the man had been convicted of child rape twice in the past. The last time was in 2008, when he was 18 years old. The daily Liberec wrote at the time that he had raped the thirteen-year-old sister of his friend from the model circle of Lidové sady in Liberec. The little girl defended herself, kicked him, but did not defend against the much bigger and stronger Jan R.. The experts then declared that the man suffered from heterosexual pedophilia and pathological sexual assault.

In addition, he was on condition, because a year earlier he had done the same thing as a teenager. Although experts at the time warned that it could be dangerous in general and suggested protective sex treatment in the facility, the court, in addition to the condition, ordered that only therapists be present.

He was sentenced to six years in prison for a second rape in 2008.

“It couldn’t be prevented”

Klára wrote about the experience of one of the mothers, added links to an Internet article about the latest conviction of Jan R. and information that she organizes children’s camps and a private kindergarten.

“Given the nature of the crime and the obvious personality pathologies, I find it alarming that this individual works in groups of children,” she wrote, asking police to check Children of Paradise Railway and the behavior of its founder and president Jan R. .

The answer came in four months. And she was very austere. “The investigation did not reveal any criminal offences,” police said in a decision deferring the report to December 22, 2021.

Liberec police spokeswoman Ivana Baláková told Radiožurnál that the police had no choice but to postpone the case to last December. “We have reviewed the report, but the results of this review do not allow us to charge the man the subject of the report,” she said.

According to her, the police could not prevent the man from finally raping another child. He was charged by criminologists last week, is currently in police custody and faces up to 12 years in prison. The police are urging parents who have entrusted children to the association to file a complaint.

However, the Liberec District Court had doubts about Jan R.’s relationship with the children. When Jan R. and his wife applied for placement of the child in foster care last June, the court rejected it, arguing that it was a “serious criminal past”.

How, then, is it possible that a doubly convicted pedophile could organize children’s camps and babysit? In February 2020, the man and his wife founded the Children of the Railway Paradise association, which was to deepen children’s interest in model making. And during the creation of the association, no one discovered their criminal record, because it does not require a clean criminal record.

There is no change in the plan

“As for the question of integrity, it is not required by the Civil Code, so this document is not a condition for someone to be a legal representative of the association,” the lawyer said. Jaroslav Ortman. “Maybe that’s a hole in the law and something to think about,” Ortman mused.

The spokeswoman for the Ministry of Education, Aneta Lednová, told Radiožurnál that the railway children did not carry out activities in accordance with the Education Law and were not and were not not registered in the school register. Because the association provided only informal activities, such as clubs, camps, and childcare, its founders did not have to have integrity. When Radiožurnál asked her if it was not appropriate to change this, she referred to the Ministry of Justice.

Its spokesman Michal Pleskot replied that the station was not going to do so. “We do not consider the condition of integrity. Association is the most common legal form of a legal person through which the public carries out a number of purely recreational and non-profit activities, and the existence of such a condition would unjustifiably exclude a large part of the population from carrying out their activities.”

Her colleague Markéta Poslušná pointed out that the courts have the possibility of prohibiting offenders from certain activities for which they have been convicted. However, when Jan R. was last convicted in 2008, he was only 18 and had not yet worked with children. Therefore, the court did not impose a ban on him at that time.
